Terms & Conditions

The terms and conditions mentioned below constitute the complete agreement between you and the Worcester Taxi Company, regarding taxi services. The use of services is an indication that you agree to the given terms and conditions, as laid out in the agreement below. This is to be regarded as being unconditional in nature.

Definitions

The terms “We” and Worcester Taxi Company” is a reference to the Worcester Taxi Company, bearing registration address in 22 Arboretum Road, Worcester, WR1 1NB, registered in Worcestershire, UK, licensed by the Worcestershire City Council.
“You” and “Your” is a reference to any individual, company, entity or other business, who registers a booking with us.

1. Booking

a) You must ensure that you book the taxi in advance, so as to ensure that you allow for any unexpected issues. This is especially true for railway bookings, airport transfers or any other such important appointments. This will allow for sufficient buffer time in case there are any exigencies. Worcester Taxi Company will not be responsible if there are any delays, due to a lack of sufficient buffer time for the aforementioned reason. The recommended time for bookings within Worcester is 30 minutes. It is recommended that you increase this buffer time, depending on your requirement.
b) Worcester Taxi Company will not provide a guarantee with regard to the luggage carrying capacity. It is advised that you have luggage that can be suitably carried in a car.
c) Should there be a need for transporting a wheelchair, it is requested that you kindly inform us about the same in advance when you make the booking.
d) The taxi bookings made from outside Worcester City boundary will be subjected to a ‘boundary charge’. This is a payment that needs to be done before the trip. The passengers wanting a taxi beyond the boundary of Worcester may incur a boundary charge unless they come within the area of Worcester.
e) There is no minimum age with regard to passengers. A child, regardless of its age, will be considered as one passenger. No concessions will be made in this regard.

2. Payment, Prices & Quotations

a) If you require price estimation on the total fare, a suitable quotation can be provided by Worcester Taxi Company, on the basis of information given by you. This is however subject to change, where Worcester Taxi Company may make necessary modifications to the same, if there are any subsequent changes to the cab requirement, the total number of passengers, etc. Do note that the quotation you are provided is a rough estimation, rather than an accurate one. You can, however, request for a fixed price at the time of booking if you so require.
b) If you require an airport transfer booking, your booking’s quote will be including a waiting period of 60 minutes after the given landing time and car parking charges. Should the wait time exceed the 60-minute limit, there will be an additional charge levied at standard rates.
Worcester Taxi Company will, however, strive to be proactive in checking for any changes in flight arrival times before a driver is dispatched. This is, however, a matter of courtesy by Worcester Taxi Company and is in no way to be considered an obligation.
c) Should you accept the price quote given to you, you will be receiving your booking details via SMS/Email. We request you to kindly check the booking details for any errors and inform us accordingly. Worcester Taxi Company will not accept any responsibility for delays or costs that may occur due to the lack of information from the customer’s end.
d) The cab bookings requiring a pickup from an airport will require the fare to be paid in advance, either in part or full, at least 36 hours before pickup. This is with regard to bookings that are a one way trip from an airport, rather than trips from elsewhere to the airport and back.
e) The payments for the cabs are to be made in cash. No other forms of payment will be accepted at this time.
f) If you require a booking for larger cabs, (which require the seating of 6 people or more), additional charges will be levied accordingly.

3. Service

a) The responsibility for the behaviour of all passengers during the trip will be held by you. Should there be any event of soiling by any passenger, there will be a charge of FARE levied.
b) Activities such as eating, drinking or smoking will not be permitted inside the cab.
c) Children travelling during the trip are to be restrained in an appropriate manner, taking into consideration their age, height and weight.
The child’s guardian is required to supply the cab with suitable seating for the child, wherever necessary. The cab driver may retain the seat if required for a return journey.
d) The number of passengers permitted in the cabs is fixed and will not be changed in any manner. These limits are in accordance with the limits stated by insurance and/or licensing.
e) Pets will be permitted, if it is deemed to be necessary for the passenger, such as blind dogs.

4. Cancellation & Refund Policy

a) In the event that you require a cancellation of your booking, we kindly request that you do the same at the earliest. If the cancellation is done after a vehicle is dispatched, you may be required to pay a charge for the same. This charge will depend on the distance and time that the driver had travelled, prior to your cancellation.
b) Refunds will be provided if the conditions meet the criteria laid out in the Terms & Conditions of this agreement.

5. Liability

a) Worcester Taxi Company will strive to ensure that you reach your destination on time as much as possible. We will however not guarantee the same, in the case of exigencies such as traffic or road conditions that are beyond our control.
In no circumstance will we be held responsible for any liabilities arising as a result of issues beyond our control, with regard to loss of profits, business or any other related consequences.
b) The luggage carried in the cabs will be at your own risk. Worcester Taxi Company will not be held liable for their loss in any way.
c) Worcester Taxi Company reserves the right to cancel the cabs, in the case of events beyond its control. These include, but are not limited to, national emergency, war, riot, terrorist attack, fuel shortage, etc. In the event that your car breaks down along the way, we shall strive to ensure that you get another cab as soon as we can arrange it.
d) By using Worcester Taxi Company, you agree to indemnify us against any costs, losses, damages and expenses that may arise from your end, due to an act or omission by any passenger travelling with you.
e) In the event of death or personal injury, neither part shall exclude or limit liability for the same. This is applicable in case they said the event was caused as a result of negligence, any kind of fraudulent misrepresentation, wilful default or any other similar circumstance. This holds true in any manner that is unenforceable by any law.
f) Worcester Taxi Company will not be held liable for any failure in performance, caused by any event beyond our control. This includes, among other things, events that may cause a limitation or failure of public or private communication networks.

6. Termination

Worcester Taxi Company reserves the right to terminate any booking made with immediate effect, should the same place the driver or vehicle in harm’s way. This includes but is not limited to damage, violence or abuse by you or any passenger travelling with you. In the event that such a cancellation occurs, we will be requesting all travellers to vacate the cab as soon as it is deemed to be safe.
In case any bookings are terminated midway by the customer, no refunds will be given in any manner.

7. Miscellaneous

a) Worcester Taxi Company may subcontract obligations laid out in this agreement to other parties. You shall not be assigning, transferring or delegating any of your rights, with regard to this agreement.
b) The terms and conditions given here are subject to change at any time, without prior notice. Any changes so made will be mentioned online at the earliest. Please ensure that you review these changes periodically and at the time of booking, so as to be aware of any changes. The fares for bookings will be charged as per the existing rates mentioned at the time booking was made.
c) Any information provided by you shall be stored, processed and used in accordance with the Data Protection Act, 1998.
d) This agreement, as well as any accompanying quotation, is representative of the entire agreement existing between you and Worcester Taxi Company. Should there arise any discrepancy in this regard, the terms and conditions laid out in this agreement shall prevail.
e) Nothing laid out in this Agreement is intended to confer any benefit on any third party. This is to be construed as true whether pursuant to the Contracts (Rights of Third Parties) Act 1999 or otherwise. Also, no third party shall be enforcing any rights under this Agreement, with the exception of cases where the same has been agreeing to in writing.
f) In the interest of your child’s safety and health, Worcester Taxi Company is unable to provide child seats in any way. In case such a seat is required, it would be the responsibility of the child’s parent/guardian to make suitable arrangements. 8. Disputes

This agreement will be subject to the exclusive jurisdiction of England and Wales and is construed in accordance with English law.
In the event that any dispute or claim arises with regard to this agreement, you and Worcester Taxi Company each agree to the exclusive jurisdiction of English and Welsh courts.
